What will the contraceptive mandate cover? - Seattle Local Health ...

While controversy over one aspect of?the Obama administration?s contraception rule ? whether and when religiously affiliated employers must comply ? has dominated recent headlines, that debate has obscured other questions about how the?rules will actually be implemented.

Under the health law, insured women will qualify for contraceptives without a copaymentas part of a range of preventive medical services. But insurers and advocates are frustrated by the lack of details. They?re asking, for example, whether surgical procedures must also be covered at no additional cost to patients.

?The unknown answers to the myriad of questions remain very worrisome,? says Judith Lichtman, senior advisor to the National Partnership for Women and Families, an advocacy group in Washington D.C.

America?s Health Insurance Plans (AHIP), the industry lobbying group, sent a list of questions to the Department of Health and Human Services (HSS) in September, asking for clarification on what types of contraceptives must be covered and how insurers should structure their policies. A spokesman for AHIP says the group is still awaiting answers to some questions.

Contraceptives are part of a package of women?s preventive health care services under the Affordable Care Act ? including screening for diabetes, counseling about sexually transmitted diseases and breast feeding support ? that must be provided without deductibles or co-pays in all new policies beginning Aug. 1. The package was drawn up after recommendations from the Institutes of Medicine (IOM). Other parts of the health law also provide no-cost-sharing preventive services for children and all adults, such as certain?cancer screenings and immunizations.

Here are some questions, and answers when we could determine them, about the rules:

1) Are male-based contraceptive methods, such as vasectomies or condoms, covered by the rule?

An HHS official said on Friday that women?s preventive services guidelines apply to women only.

Guidelines issued by the Health Resources and Services Administration, part of HHS, require coverage without cost sharing for ?all Food and Drug Administration-approved contraceptive methods, sterilization procedures and patient education and counseling for all women with reproductive capacity? as prescribed by a provider, according to the Federal Register.

The insurers? letter from September says they interpreted the rule to include only female-based contraception and that the requirement to waive co-payments ?does not apply to methods and procedures intended for males.?

But Adam Sonfield, senior public policy associate at the Guttmacher Institute, a reproductive health research group, says the language is unclear, and it would be foolish to exclude vasectomies. For one thing, he says, they are less expensive and pose a lower risk of complications than female surgical sterilization methods. Plus, he says, waiving co-payments for services for one sex but not the other raises issues of discrimination.

?I can?t see how it would be in anyone?s interest to treat them differently,? says Sonfield.

2) Are over-the-counter products like female condoms, spermicides, sponges covered by the rules and, if so, will they require a prescription and how will insurers reimburse policyholders for purchases at retail stores?

Products that must be covered without cost-sharing include over-the- counter contraceptives when they are prescribed by doctors, the HHS official said Friday. But getting a prescription for such items raises other issues, say advocates and insurers.

Insurers wrote HHS in September that ?it is unclear what specific over-the-counter products are to be included.?

In addition, the letter warned that requiring a prescription for such items ?would increase the burden on an already over-burdened primary care system and drive up administrative costs.?

Insurers wrote the industry has no simple way to track and reimburse policyholders who purchase those items at retail stores. Setting up such systems, ?could cost tens of millions? and exceed the cost of the products themselves.

Requiring a prescription should definitely not be required, says Lichtman, who said such a move would make using contraception more difficult and expensive for women.

3) If a hospital stay is required for surgical procedures, such as when a women gets her tubes tied, would the procedure be covered without cost sharing?

Insurers say it is not clear if hospitalization or complications that might occur from surgery would be covered without the patient paying a co-payment or a deductible because they are not considered preventive.

Sonfield at Guttmacher argues they would be covered.

?It?s like saying you have to cover blood transfusions, but not the hospital stay,? he says. ?That doesn?t make sense. If you?re covering it, you?re covering it all.?

HHS has not weighed in on this question, but is expected to issue additional guidance in the coming months.

4) Will insurers be required to cover all products in a class, such as all IUDs, or all birth control pills? Can insurers require a co-pay for a brand-name drug if a generic is available?

Many insurers have ?tiered? pharmacy benefits under which patients pay differing amounts for brand-name, as opposed to generic, products. Some require patients who choose a brand-name drug, when an equivalent generic is available, to pay the price difference between the two. Insurers say HHS guidance allows them to use such ?reasonable medical management? to help control costs. That would include allowing insurers to charge patients for brand name drugs, it says.

The HHS official confirmed that, but stressed the plan must ?accommodate any individuals for whom it would be medically inappropriate by having a mechanism for waiving the otherwise applicable cost-sharing for the branded version.?

Advocacy groups and insurers are in discussions with HHS over those and other questions related to preventive care, says Lichtman. Her group hopes the agency will soon release additional guidelines that ?are broad enough so that all methods prescribed by doctors necessary for women?s health will be covered.?

5) Who will be covered for contraceptives without co-payments?

The package of women?s preventive care benefits must be offered in all new insurance policies sold to individuals and employers starting Aug. 1, as well as in most policies that renew afterwards on the date that they renew. There is an?exception?for insurance provided by certain nonprofit religious employers who object to birth control.

Twenty-eight states already require insurers to cover contraceptives, although large, self-insured employers are generally exempted from state rules. But a 2010 Kaiser Family Foundation/HRET?survey?of employers found that 85 percent of large firms offered prescription contraceptives in their plans, although they often required a patient co-pay or deductible. (KHN is a program of the foundation)

As for the types of procedures covered, the IOM cites a 2011 Bureau of Labor Statistics?analysis?of 3,900 employer plans, which found that policy documents representing about 70 percent of participants did not mention sterilization. But when sterilization services were mentioned, nearly 90 percent of the policies covered both female and male surgical sterilization procedures.

When Rick Ross experiences a personal moment of triumph, a hearty grunt typically marks the occasion. Built up from the bowels of his belly, Rozay's baritone call has become as ubiquitous as his titillating one-liners — not that a simple ad-lib is the only thing that earned Rick Ross the #1 spot on MTV News' Hottest MCs in the Game VII list, his first time up top.

Rozay was on pace to release his fifth studio album until he faced a pair of "minor setbacks," as he so poetically dubs the two seizures he suffered in October.

"God Forgives, I Don't was slated to come out in 2011, and he had the two seizures, and we thought it was going to make him fall back completely — but he came back and hit us with Rich Forever," MTV News senior hip-hop writer Rob Markman pointed out during the Hottest debate.

"I don't think any artist did a better job of branding than Rick Ross," said MTV RapFix blog editor Nadeska Alexis. "He was just a marketing genius this year, and you gotta give it to the man."

Mountain man invades cabins, lives in luxury

SALT LAKE CITY?? He's eluded authorities for more than five years, a mountain man who roams the wilderness of southern Utah, breaking into remote cabins in winter, living in luxury off hot food, alcohol and coffee before stealing provisions and vanishing into the woods.

Investigators have clawed for clues, scouring cabins for fingerprints that match no one and chasing reports of brief encounters only to come up short, always a step behind the mysterious recluse.

They've found abandoned camps, dozens of guns, high-end outdoor gear stolen from the homes and trash strewn around the forest floor.

But the man authorities say is armed and dangerous and responsible for more than two dozen burglaries has continued to outrun the law across a swath of mountains not far from Zion National Park. He's roamed across 1,000 square miles of rugged wilderness where snow can pile 10 feet deep in winter.

And while there have been no violent confrontations, detectives say he's a time bomb. Lately he has been leaving the cabins in disarray and riddled with bullets after defacing religious objects, and a recent note left behind in one cabin warned, "Get off my mountain."

"You wouldn't want to come across that guy," said Iron County Det. Jody Edwards, who has been working the case since 2007.

Theories about his identity have ranged from a 42-year-old man on the FBI's Most Wanted List sought for the 2004 killing of an armored-truck guard in Phoenix to a castaway from the nearby compounds of the Fundamentalist Church of Jesus Christ of Latter Day Saints, the polygamous sect headed by jailed leader Warren Jeffs.

The FBI recently discounted the theory that the man was their fugitive after authorities got the first pictures of him from a motion-triggered surveillance camera outside a cabin showing a sandy-haired man in camouflage on snowshoes, a rifle slung over his shoulder. The photos were captured sometime in December.

"We believe that is not Jason Derek Brown," FBI special agent Manuel Johnson told The Associated Press.

However, Edwards isn't so quick to rule out the possibility, given the close resemblance to Brown, who was raised Mormon and is a highly educated, well-traveled avid outdoorsman.

So while detectives believe they are getting close, buoyed by the recent photos, the shadowy survivalist remains an enigma. No missing person report appears to fit, and fingerprints lifted from cabins have yielded no match.

More frightened
Meanwhile, cabin owners are growing more frightened by the day and are left wondering who might be sleeping in their beds this winter.

"He's scaring the daylights out of cabin owners. Now everyone's packing guns," said Jud Hendrickson, a 62-year-old mortgage adviser from nearby St. George who keeps a trailer in the area.

In November 2010, Bruce Stucki, another cabin owner, said a burglar broke into his cabin through a narrow window, pried open a gun case with a crowbar and laid out the weapons but took none. At a nearby cabin, the man reportedly took only the grips from gun handles.

"He could stand in the trees and pop you off and no one would know who killed you," Stucki said.

Some cabins he has left tidy and clean, while others he has practically destroyed, even defecating in one in a pan on the floor.

"He should know he's being followed, but I don't think this guy is normal in any way," said Stucki, who, like many cabin owners, has a lot of his own theories.

"He's anti-religious, waiting for the mothership to come in," Stucki speculated.

Investigators say they have found several of the man's unattended summer camps, what they initially thought were left behind by "doomsday" believers preparing for some sort of apocalypse because of the remote locations and supplies like weapons, radios, batteries, dehydrated food and camping gear.

Stocked with guns
Edwards said two camps found a few years ago were stocked with 19 guns. One of the camps also had a copy of Jon Krakauer's "Into the Wild," a book about a young man who died after wandering into the Alaskan wilderness to live alone off the land.

The cabin burglar has managed to avoid being seen all but twice over the years, each time retreating into the forest.

The coffee and alcohol the survivalist favors plays into some cabin owners' assessment that he could be a castaway from the nearby twin towns of Hildale or Colorado City on the Utah-Arizona border. The so-called lost boys are said to be regularly booted from the polygamous sect there by elders looking to increase their marriage opportunities with young women.

Unlike members of The Church of Jesus Christ of Latter-day Saints, which discourages consumption of alcohol and coffee, many of the Mormon fundamentalists imbibe.

Detectives aren't sharing their latest assessments but "we've got a lot of leads" from the surveillance photos, Edwards said. "I would say we're very close to making a positive ID on him. We just got to catch this guy."

To cabin owners in southern Utah, he remains a spooky and menacing figure.

"We feel like we're being subject to terrorism by this guy," Hendrickson said. "My wife says flat-out she's not going back to our trailer until they catch him."

The rising cost of higher education, its indifferent quality, its resistance to change, and its lack of accountability are endangering the nation?s prospects for future economic growth, according to a report on the views of business executives that was released today by Public Agenda and the Committee for Economic Development. The report, which draws on focus groups last year with 27 executives in Ohio and Texas, and on telephone interviews with 12 others, echoes the concerns that business leaders have expressed in two other recent reports that cover similar terrain: one based on a survey of 500 business leaders released in January and one based on a survey of more than 1,000 employers released in September. In the new report, ?Hiring and Higher Education,? the business leaders say colleges? inability to control their costs, lack of adaptability, and meager accountability have resulted in a dearth of qualified workers for the jobs the leaders need to fill.

LOS ANGELES (AP) ? The Grammys got under way on Sunday, with the Recording Academy trying to focus on music's biggest night after of the death of one of music's biggest names ? Whitney Houston.

Houston died on the eve of the Grammys at the Beverly Hilton Hotel, where she was preparing to attend a pre-Grammy party. Her death cast a huge shadow over the event. As the pre-telecast awards ceremony began, co-host Dave Koz acknowledged the tragedy, noting the "great legacy of Miss Whitney Houston. She's in our hearts and our minds."

A tribute to Houston featuring Jennifer Hudson was to take place during the main ceremony later Sunday.

Before the death of one of pop music's most important figures, the Grammy buzz focused on whether Adele ? 2011's top-selling artist and set to make her first public performance on the show since having vocal cord surgery ? would be the queen of the Grammys. Although Kanye West leads all nominees with seven and Bruno Mars and the Foo Fighters tied Adele with six nominations, she was favored to sweep all of her categories.

But as show time neared, the focus remained on Houston's death.

Grammy show producer Ken Ehrlich was quick to announce Hudson's tribute. "It's too fresh in everyone's memory to do more at this time," he said late Saturday, "but we would be remiss if we didn't recognize Whitney's remarkable contribution to music fans in general, and in particular her close ties with the Grammy telecast and her Grammy wins and nominations over the years."

More Houston tributes from nominees and presenters are expected during the three-and-a-half hour Staples Center show, which was to feature the Foo Fighters, Mars, Nicki Minaj, Bruce Springsteen, Paul McCartney, Taylor Swift, Chris Brown and Riha0nna.

It will mark the first time Rihanna and Brown have appeared at the same awards show since his attack on her three years ago ? also on the eve of the Grammys ? forced both to drop out of the show and led to an assault conviction for Brown. It almost derailed his career, but 2011 marked a huge comeback, and he was rewarded with a Grammy performance slot on Sunday night's CBS broadcast.

Rihanna is also a nominee, up for album of the year. She is competing with Adele's "21," Mars' "Doo-Woops & Hooligans," the Foo Fighters "Wasting Light" and Lady Gaga's "Born This Way."

Adele's "Rolling in the Deep" is nominated for record and song of the year. Both categories also include Bon Iver's "Holocene," Mumford & Sons "The Cave," and Mars' "Grenade." Katy Perry's "Firework" is up for record of the year but instead of that song, West's "All of the Lights" takes the remaining position in the song of the year category.

The ceremony also marks the first since a major overhaul of the categories last year, which led to them being trimmed from 109 to 78. The move upset some musicians, and a protest was planned outside of the Staples Center on Sunday.
